1. Общие положения

Настоящее Пользовательское соглашение (далее — «Соглашение») регулирует порядок использования сервиса Aiaate Systems (далее — «Сервис»).

Aiaate Systems — цифровая платформа для предпринимателей, основателей проектов и специалистов, включающая:

• AI-ассистента для анализа и развития проектов;
• инструменты взаимодействия участников сообщества;
• функции создания профиля проекта;
• возможность обмена информацией и поиска профессиональных контактов.

Оператором Сервиса является:

Использование Сервиса, включая регистрацию учётной записи, создание профиля или использование отдельных функций Сервиса, означает полное и безоговорочное принятие Пользователем условий настоящего Соглашения.

Сервис предназначен для лиц, достигших возраста 18 лет.

Используя Сервис, Пользователь подтверждает, что достиг возраста 18 лет.

2. Возможности Сервиса

Пользователь получает возможность:

• использовать AI-ассистента для обсуждения вопросов развития проекта;
• получать автоматически сформированные рекомендации;
• создавать профиль проекта;
• участвовать в сообществе пользователей;
• публиковать материалы и взаимодействовать с другими участниками;
• искать потенциальных партнёров и профессиональные контакты.

На момент публикации настоящего Соглашения основные функции Сервиса предоставляются бесплатно, если иное прямо не указано Оператором.

Оператор вправе:

• вводить платные функции;
• изменять условия использования отдельных возможностей Сервиса;
• предлагать дополнительные услуги.

Информация об изменении условий использования Сервиса может размещаться внутри интерфейса Сервиса или на Сайте.

3. Работа AI-ассистента

AI-ассистент использует технологии искусственного интеллекта для обработки пользовательских запросов и формирования ответов.

Пользователь понимает и принимает, что:

• ответы AI формируются автоматически;
• AI может допускать ошибки;
• информация может быть неполной, неточной или требовать дополнительной проверки;
• AI не заменяет профессиональную консультацию специалистов.

Ответы AI не являются:

• юридической консультацией;
• финансовой консультацией;
• налоговой консультацией;
• инвестиционной рекомендацией;
• гарантией достижения определённых результатов.

Перед принятием важных решений Пользователь самостоятельно оценивает полученную информацию и при необходимости обращается к профильным специалистам.

Все решения, принятые Пользователем на основании информации, полученной через Сервис, принимаются Пользователем самостоятельно.

Пользователь самостоятельно определяет объём информации, предоставляемой AI-ассистенту.

Пользователь несёт ответственность за содержание информации, передаваемой AI-ассистенту, включая наличие необходимых прав на использование такой информации.

Пользователь не должен передавать через Сервис сведения, составляющие государственную тайну, коммерческую тайну или иную охраняемую законом информацию, если использование таких сведений не предусмотрено условиями Сервиса.

4. Ограничение назначения Сервиса

Aiaate Systems:

• не является инвестиционной платформой;
• не является финансовым посредником;
• не осуществляет управление инвестициями;
• не предоставляет профессиональные юридические, финансовые, налоговые или инвестиционные услуги.

Сервис предназначен для:

• информационной поддержки;
• анализа идей;
• структурирования информации;
• помощи в развитии проектов.

Использование Сервиса не означает получение профессиональной консультации или гарантии достижения определённого результата.

5. Правила использования сообщества

Пользователь обязуется:

• соблюдать уважительное отношение к другим участникам;
• не размещать оскорбительный или незаконный контент;
• не распространять чужие персональные данные без законных оснований;
• не использовать Сервис для спама, мошенничества или фишинга;
• не размещать рекламу, не связанную с тематикой сообщества;
• публиковать материалы, соответствующие тематике предпринимательства и развития проектов.

Запрещается:

• предпринимать попытки нарушить работу Сервиса;
• получать несанкционированный доступ к системам Сервиса;
• использовать автоматизированные средства для злоупотребления функциональностью Сервиса;
• совершать действия, способные причинить вред Сервису или другим пользователям.

6. Пользовательский контент

Пользователь сохраняет права на созданные им материалы, включая:

• описание проекта;
• публикации;
• текстовые материалы;
• информацию профиля;
• иные материалы, самостоятельно размещённые Пользователем.

Пользователь самостоятельно определяет, какие материалы размещать в Сервисе и какие сведения делать доступными другим пользователям в рамках функциональности сообщества.

Размещая контент в Сервисе, Пользователь предоставляет Оператору неисключительное право использовать такой контент исключительно для:

• отображения внутри Сервиса;
• обеспечения работы функций платформы;
• предоставления доступа другим пользователям в рамках функциональности сообщества;
• технического функционирования Сервиса.

Настоящее право не означает передачу права собственности на пользовательский контент.

Указанное право предоставляется на срок использования соответствующего функционала Сервиса и исключительно в объёме, необходимом для работы платформы.

7. Интеллектуальная собственность

7.1.

Все исключительные права на сервис Aiaate Systems, включая, но не ограничиваясь:

• программным кодом;
• архитектурой программного обеспечения;
• дизайном интерфейса;
• элементами пользовательского опыта (UX);
• текстовыми и графическими материалами;
• логотипами и обозначениями;
• базами данных;
• структурой и содержанием информационных материалов;
• иными элементами сервиса,

принадлежат Оператору либо используются им на законных основаниях.

7.2.

Использование сервиса не означает передачу Пользователю исключительных прав на какие-либо элементы Aiaate Systems.

Пользователю предоставляется ограниченное, неисключительное право использовать сервис исключительно в целях, предусмотренных настоящим Пользовательским соглашением.

7.3.

Пользователь не вправе без предварительного письменного согласия Оператора:

• копировать, воспроизводить или распространять элементы сервиса;
• извлекать исходный код, осуществлять обратную разработку (reverse engineering), декомпиляцию или попытки получения доступа к исходному коду;
• создавать производные продукты на основе сервиса;
• использовать дизайн, структуру или материалы Aiaate Systems для создания аналогичных решений;
• удалять уведомления об авторских правах и иных правах интеллектуальной собственности.

7.4.

Наименование Aiaate Systems, элементы фирменного стиля, логотипы и иные обозначения могут являться объектами интеллектуальной собственности и не могут использоваться без согласия правообладателя.

7.5.

Размещение Пользователем материалов в сервисе не передаёт Оператору право собственности на такие материалы.

Пользователь сохраняет права на принадлежащие ему материалы и предоставляет Оператору право использовать их только в объёме, необходимом для функционирования сервиса.

8. Использование сторонних сервисов

Для обеспечения работы отдельных функций Aiaate Systems Оператор может использовать сторонние информационные системы и сервисы, включая:

• сервисы искусственного интеллекта;
• сервисы аналитики;
• инфраструктурные сервисы;
• иные технические решения.

Перечень используемых сервисов может изменяться в зависимости от технической архитектуры Сервиса.

Использование таких сервисов осуществляется в соответствии с:

• Политикой обработки персональных данных;
• Политикой использования файлов cookie;
• иными документами Сервиса.

Отдельные функции AI могут предполагать передачу пользовательских запросов и технических данных поставщикам соответствующих сервисов в объёме, необходимом для функционирования таких функций.

Порядок обработки данных такими сервисами определяется также документами, указанными в Политике обработки персональных данных.

9. Ограничение ответственности

Оператор предоставляет доступ к Сервису Aiaate Systems в пределах доступной функциональности на момент использования Сервиса.

Пользователь понимает и принимает, что:

• отдельные функции Сервиса могут изменяться, временно ограничиваться или быть недоступны по техническим причинам;
• в работе Сервиса возможны технические ошибки, сбои или перерывы;
• результаты работы AI-ассистента формируются автоматически и могут содержать неточности, ошибки или требовать дополнительной проверки;
• AI-ассистент не является заменой профессиональной консультации специалистов.

Оператор не гарантирует:

• непрерывную и бесперебойную работу Сервиса;
• отсутствие технических ошибок;
• соответствие результатов работы AI-ассистента ожиданиям Пользователя;
• достижение Пользователем конкретных бизнес-, финансовых или иных результатов.

Пользователь самостоятельно принимает решения на основании информации, полученной с использованием Сервиса, и несёт ответственность за последствия таких решений.

Оператор не несёт ответственности за:

• решения, принятые Пользователем на основании информации, полученной через Сервис;
• результаты применения рекомендаций AI-ассистента;
• действия других пользователей Сервиса;
• содержание пользовательского контента, размещённого Пользователями;
• невозможность использования Сервиса по причинам, не зависящим от Оператора.

Если иное не предусмотрено обязательными нормами законодательства Российской Федерации, Оператор не несёт ответственности за косвенные убытки, упущенную выгоду и последствия, возникшие вследствие самостоятельного использования Пользователем информации, полученной через Сервис.

Ответственность Оператора определяется законодательством Российской Федерации.

10. Изменение и прекращение работы Сервиса

Оператор вправе:

• изменять функциональность Сервиса;
• добавлять или удалять отдельные функции;
• временно ограничивать доступ;
• прекращать работу Сервиса.

При существенных изменениях Оператор может уведомить Пользователей через интерфейс Сервиса или электронную почту.

Оператор вправе ограничить или прекратить доступ Пользователя без предварительного уведомления в случаях:

• нарушения настоящего Соглашения;
• угрозы безопасности Сервиса;
• незаконного использования платформы;
• действий, нарушающих права других пользователей.

11. Персональные данные

Обработка персональных данных Пользователей осуществляется в соответствии с:

• Политикой обработки персональных данных Aiaate Systems;
• Политикой использования файлов cookie;
• иными документами, размещёнными на Сайте и в интерфейсе Сервиса.

12. Пользователи за пределами Российской Федерации

Пользователи, находящиеся за пределами Российской Федерации, могут обладать дополнительными правами в соответствии с законодательством страны своего нахождения.

13. Применимое право и споры

Настоящее Соглашение регулируется законодательством Российской Федерации.

Все разногласия стороны стремятся решить путём переговоров.

При невозможности урегулирования спор рассматривается в соответствии с законодательством Российской Федерации.

14. Приоритет языка

В случае перевода настоящего Соглашения на другие языки юридическую силу имеет версия документа на русском языке.

2. Service Capabilities

The User may:

• use the AI assistant to discuss project development topics;
• receive automatically generated recommendations;
• create a project profile;
• participate in the user community;
• publish content and interact with other participants;
• search for potential partners and professional contacts.

At the time of publication of this Agreement, the main Service features are provided free of charge, unless otherwise expressly stated by the Operator.

The Operator has the right to:

• introduce paid features;
• modify the terms of use of individual Service features;
• offer additional services.

Information about changes to Service terms may be posted within the Service interface or on the Website.

3. AI Assistant Operation

The AI assistant uses artificial intelligence technologies to process user queries and generate responses.

The User understands and accepts that:

• AI responses are generated automatically;
• AI may make mistakes;
• information may be incomplete, inaccurate or require additional verification;
• AI does not replace professional expert consultation.

AI responses do not constitute:

• legal advice;
• financial advice;
• tax advice;
• an investment recommendation;
• a guarantee of achieving specific results.

Before making important decisions, the User independently evaluates the information obtained and, where necessary, consults with relevant professionals.

All decisions made by the User based on information obtained through the Service are made by the User independently.

The User independently determines the scope of information provided to the AI assistant.

The User is responsible for the content of information transmitted to the AI assistant, including having the necessary rights to use such information.

The User must not transmit through the Service information constituting a state secret, trade secret or other information protected by law, unless the use of such information is provided for by the Service terms.

4. Scope Limitations

Aiaate Systems:

• is not an investment platform;
• is not a financial intermediary;
• does not provide investment management services;
• does not provide professional legal, financial, tax or investment services.

The Service is intended for:

• informational support;
• idea analysis;
• information structuring;
• assistance with project development.

Using the Service does not constitute receiving professional advice or a guarantee of achieving a specific result.

5. Community Rules

The User agrees to:

• treat other participants with respect;
• not post offensive or unlawful content;
• not distribute others' personal data without lawful grounds;
• not use the Service for spam, fraud or phishing;
• not place advertising unrelated to the community's subject matter;
• publish content relevant to entrepreneurship and project development.

The following are prohibited:

• attempts to disrupt Service operation;
• obtaining unauthorised access to Service systems;
• using automated means to abuse Service functionality;
• actions capable of causing harm to the Service or other users.

6. User Content

The User retains rights to content they create, including:

• project descriptions;
• posts;
• text materials;
• profile information;
• other content independently posted by the User.

The User independently determines what content to post in the Service and what information to make available to other users within the community functionality.

By posting content in the Service, the User grants the Operator a non-exclusive right to use such content exclusively for:

• display within the Service;
• supporting platform functionality;
• providing access to other users within the community functionality;
• technical operation of the Service.

This right does not constitute a transfer of ownership of user content.

This right is granted for the period of use of the relevant Service functionality and exclusively to the extent necessary for platform operation.

7. Intellectual Property

7.1.

All exclusive rights to the Aiaate Systems service, including but not limited to:

• source code;
• software architecture;
• interface design;
• user experience (UX) elements;
• text and graphic materials;
• logos and designations;
• databases;
• structure and content of information materials;
• other elements of the service,

belong to the Operator or are used by the Operator on lawful grounds.

7.2.

Use of the service does not entail the transfer to the User of exclusive rights to any elements of Aiaate Systems.

The User is granted a limited, non-exclusive right to use the service solely for the purposes set out in these Terms of Service.

7.3.

Without the Operator's prior written consent, the User may not:

• copy, reproduce or distribute elements of the service;
• extract source code, perform reverse engineering, decompilation or attempts to gain access to the source code;
• create derivative products based on the service;
• use the design, structure or materials of Aiaate Systems to create similar solutions;
• remove copyright notices and other intellectual property rights notices.

7.4.

The name Aiaate Systems, brand identity elements, logos and other designations may constitute intellectual property objects and may not be used without the rightsholder's consent.

7.5.

The User's placement of materials in the service does not transfer ownership of such materials to the Operator.

The User retains rights to their materials and grants the Operator the right to use them only to the extent necessary for the operation of the service.

8. Use of Third-Party Services

To support the operation of certain Aiaate Systems features, the Operator may use third-party information systems and services, including:

• artificial intelligence services;
• analytics services;
• infrastructure services;
• other technical solutions.

The list of services used may change depending on the technical architecture of the Service.

The use of such services is carried out in accordance with:

• the Personal Data Processing Policy;
• the Cookie Policy;
• other Service documents.

Certain AI features may involve the transfer of user requests and technical data to providers of the relevant services to the extent necessary for the operation of such features.

The data processing procedures of such services are also governed by the documents referred to in the Personal Data Processing Policy.

9. Limitation of Liability

The Operator provides access to the Aiaate Systems Service within the available functionality at the time of use.

The User understands and accepts that:

• certain Service features may change, be temporarily restricted or unavailable for technical reasons;
• technical errors, failures or interruptions may occur in the operation of the Service;
• AI assistant results are generated automatically and may contain inaccuracies, errors or require additional verification;
• the AI assistant is not a substitute for professional expert consultation.

The Operator does not guarantee:

• continuous and uninterrupted Service operation;
• absence of technical errors;
• that AI assistant results will meet the User's expectations;
• that the User will achieve specific business, financial or other results.

The User independently makes decisions based on information obtained using the Service and is responsible for the consequences of such decisions.

The Operator is not liable for:

• decisions made by the User based on information obtained through the Service;
• outcomes of applying AI assistant recommendations;
• actions of other Service users;
• content of user content posted by Users;
• inability to use the Service for reasons beyond the Operator's control.

Unless otherwise provided by mandatory provisions of the legislation of the Russian Federation, the Operator shall not be liable for indirect losses, loss of profit and consequences arising from the User's independent use of information obtained through the Service.

The Operator's liability is determined by the legislation of the Russian Federation.

10. Modification and Discontinuation of the Service

The Operator has the right to:

• modify Service functionality;
• add or remove individual features;
• temporarily restrict access;
• discontinue the Service.

For significant changes, the Operator may notify Users via the Service interface or email.

The Operator has the right to restrict or terminate a User's access without prior notice in cases of:

• violation of this Agreement;
• threats to Service security;
• unlawful use of the platform;
• actions that violate the rights of other users.

11. Personal Data

The processing of Users' personal data is carried out in accordance with:

• the Aiaate Systems Personal Data Processing Policy;
• the Cookie Policy;
• other documents published on the Website and in the Service interface.

12. Users outside the Russian Federation

Users located outside the Russian Federation may have additional rights under the legislation of their country of residence.

13. Applicable Law and Disputes

This Agreement is governed by the legislation of the Russian Federation.

All disputes shall be resolved through negotiation.

If settlement is not possible, the dispute shall be resolved in accordance with the legislation of the Russian Federation.

In the event this Agreement is translated into other languages, the Russian-language version shall have legal force.

2. Funcionalidades del Servicio

El Usuario puede:

• utilizar el asistente de IA para tratar temas de desarrollo del proyecto;
• recibir recomendaciones generadas automáticamente;
• crear un perfil de proyecto;
• participar en la comunidad de usuarios;
• publicar contenido e interactuar con otros participantes;
• buscar socios potenciales y contactos profesionales.

En la fecha de publicación del presente Acuerdo, las funciones principales del Servicio se prestan gratuitamente, salvo que el Operador indique expresamente lo contrario.

El Operador tiene derecho a:

• introducir funciones de pago;
• modificar las condiciones de uso de determinadas funciones del Servicio;
• ofrecer servicios adicionales.

La información sobre cambios en las condiciones de uso del Servicio puede publicarse en la interfaz del Servicio o en el Sitio web.

3. Funcionamiento del asistente de IA

El asistente de IA utiliza tecnologías de inteligencia artificial para procesar las consultas de los usuarios y generar respuestas.

El Usuario comprende y acepta que:

• las respuestas de la IA se generan automáticamente;
• la IA puede cometer errores;
• la información puede ser incompleta, inexacta o requerir verificación adicional;
• la IA no sustituye la consulta profesional especializada.

Las respuestas de la IA no constituyen:

• asesoramiento jurídico;
• asesoramiento financiero;
• asesoramiento fiscal;
• una recomendación de inversión;
• una garantía de obtención de resultados determinados.

Antes de tomar decisiones importantes, el Usuario evalúa la información de forma independiente y, cuando sea necesario, consulta a profesionales especializados.

Todas las decisiones que tome el Usuario basándose en la información obtenida a través del Servicio son adoptadas por el Usuario de forma independiente.

El Usuario determina de forma independiente el volumen de información proporcionada al asistente de IA.

El Usuario es responsable del contenido de la información transmitida al asistente de IA, incluyendo la existencia de los derechos necesarios para utilizar dicha información.

El Usuario no debe transmitir a través del Servicio información que constituya secreto de Estado, secreto comercial u otra información protegida por la ley, si el uso de dicha información no está previsto en las condiciones del Servicio.

4. Limitación del alcance del Servicio

Aiaate Systems:

• no es una plataforma de inversión;
• no es un intermediario financiero;
• no presta servicios de gestión de inversiones;
• no presta servicios profesionales jurídicos, financieros, fiscales o de inversión.

El Servicio está destinado a:

• el apoyo informativo;
• el análisis de ideas;
• la estructuración de información;
• la asistencia en el desarrollo de proyectos.

El uso del Servicio no implica la obtención de asesoramiento profesional ni garantiza la consecución de un resultado determinado.

5. Normas de uso de la comunidad

El Usuario se compromete a:

• mantener un trato respetuoso hacia los demás participantes;
• no publicar contenido ofensivo o ilícito;
• no difundir datos personales de terceros sin base legal;
• no utilizar el Servicio para spam, fraude o phishing;
• no publicar publicidad no relacionada con la temática de la comunidad;
• publicar contenido relevante para el emprendimiento y el desarrollo de proyectos.

Está prohibido:

• intentar interrumpir el funcionamiento del Servicio;
• obtener acceso no autorizado a los sistemas del Servicio;
• utilizar medios automatizados para abusar de la funcionalidad del Servicio;
• realizar acciones que puedan causar daño al Servicio o a otros usuarios.

6. Contenido del usuario

El Usuario conserva los derechos sobre el contenido que crea, incluyendo:

• descripciones de proyectos;
• publicaciones;
• materiales de texto;
• información del perfil;
• otros contenidos publicados de forma independiente por el Usuario.

El Usuario determina de forma independiente qué contenido publicar en el Servicio y qué información hacer accesible a otros usuarios en el marco de la funcionalidad de la comunidad.

Al publicar contenido en el Servicio, el Usuario otorga al Operador un derecho no exclusivo para usar dicho contenido exclusivamente para:

• su visualización dentro del Servicio;
• el funcionamiento de las funciones de la plataforma;
• proporcionar acceso a otros usuarios en el marco de la funcionalidad de la comunidad;
• el funcionamiento técnico del Servicio.

Este derecho no implica la transferencia de la propiedad del contenido del usuario.

El derecho indicado se otorga por el período de uso de la funcionalidad correspondiente del Servicio y exclusivamente en la medida necesaria para el funcionamiento de la plataforma.

El tratamiento de datos personales se realiza de conformidad con:

7. Propiedad intelectual

7.1.

Todos los derechos exclusivos sobre el servicio Aiaate Systems, incluyendo, entre otros:

• código fuente;
• arquitectura del software;
• diseño de interfaz;
• elementos de experiencia de usuario (UX);
• materiales de texto y gráficos;
• logotipos y designaciones;
• bases de datos;
• estructura y contenido de los materiales informativos;
• otros elementos del servicio,

pertenecen al Operador o son utilizados por él sobre fundamento legal.

7.2.

El uso del servicio no implica la transferencia al Usuario de derechos exclusivos sobre ningún elemento de Aiaate Systems.

Al Usuario se le otorga un derecho limitado y no exclusivo de usar el servicio exclusivamente para los fines previstos en el presente Acuerdo de usuario.

7.3.

Sin el consentimiento previo y por escrito del Operador, el Usuario no podrá:

• copiar, reproducir o distribuir elementos del servicio;
• extraer el código fuente, realizar ingeniería inversa (reverse engineering), descompilación o intentos de acceder al código fuente;
• crear productos derivados basados en el servicio;
• usar el diseño, la estructura o los materiales de Aiaate Systems para crear soluciones similares;
• eliminar avisos de derechos de autor y otros avisos de propiedad intelectual.

7.4.

El nombre Aiaate Systems, los elementos de identidad corporativa, los logotipos y otras designaciones pueden ser objetos de propiedad intelectual y no pueden utilizarse sin el consentimiento del titular de derechos.

7.5.

La publicación de materiales por parte del Usuario en el servicio no transfiere al Operador la propiedad de dichos materiales.

El Usuario conserva los derechos sobre sus materiales y otorga al Operador el derecho a utilizarlos únicamente en la medida necesaria para el funcionamiento del servicio.

8. Uso de servicios de terceros

Para el funcionamiento de determinadas funciones de Aiaate Systems, el Operador puede utilizar sistemas de información y servicios de terceros, incluyendo:

• servicios de inteligencia artificial;
• servicios de análisis;
• servicios de infraestructura;
• otras soluciones técnicas.

La lista de servicios utilizados puede cambiar en función de la arquitectura técnica del Servicio.

El uso de dichos servicios se lleva a cabo de conformidad con:

• la Política de tratamiento de datos personales;
• la Política de cookies;
• otros documentos del Servicio.

Determinadas funciones de IA pueden implicar la transferencia de solicitudes de usuarios y datos técnicos a los proveedores de los servicios correspondientes en la medida necesaria para el funcionamiento de dichas funciones.

El procedimiento de tratamiento de datos por parte de dichos servicios también se rige por los documentos indicados en la Política de tratamiento de datos personales.

9. Limitación de responsabilidad

El Operador proporciona acceso al Servicio Aiaate Systems dentro de la funcionalidad disponible en el momento del uso del Servicio.

El Usuario comprende y acepta que:

• determinadas funciones del Servicio pueden modificarse, restringirse temporalmente o no estar disponibles por razones técnicas;
• pueden producirse errores técnicos, fallos o interrupciones en el funcionamiento del Servicio;
• los resultados del asistente de IA se generan automáticamente y pueden contener inexactitudes, errores o requerir verificación adicional;
• el asistente de IA no sustituye la consulta profesional especializada.

El Operador no garantiza:

• el funcionamiento continuo e ininterrumpido del Servicio;
• la ausencia de errores técnicos;
• que los resultados del asistente de IA se ajusten a las expectativas del Usuario;
• que el Usuario alcance resultados comerciales, financieros u otros resultados específicos.

El Usuario toma de forma independiente decisiones basadas en la información obtenida mediante el Servicio y es responsable de las consecuencias de dichas decisiones.

El Operador no es responsable de:

• las decisiones adoptadas por el Usuario basándose en la información obtenida a través del Servicio;
• los resultados de aplicar las recomendaciones del asistente de IA;
• las acciones de otros usuarios del Servicio;
• el contenido del contenido de usuario publicado por los Usuarios;
• la imposibilidad de utilizar el Servicio por razones ajenas al Operador.

Salvo que la legislación obligatoria de la Federación Rusa disponga lo contrario, el Operador no será responsable de los daños indirectos, el lucro cesante y las consecuencias derivadas del uso independiente por parte del Usuario de la información obtenida a través del Servicio.

La responsabilidad del Operador se rige por la legislación de la Federación Rusa.

10. Modificación y cese del Servicio

El Operador tiene derecho a:

• modificar la funcionalidad del Servicio;
• añadir o eliminar funciones individuales;
• restringir temporalmente el acceso;
• cesar el Servicio.

Ante cambios significativos, el Operador puede notificar a los Usuarios a través de la interfaz del Servicio o por correo electrónico.

El Operador tiene derecho a restringir o cancelar el acceso del Usuario sin previo aviso en caso de:

• incumplimiento del presente Acuerdo;
• amenaza a la seguridad del Servicio;
• uso ilícito de la plataforma;
• acciones que vulneren los derechos de otros usuarios.

11. Datos personales

El tratamiento de los datos personales de los Usuarios se realiza de conformidad con:

• la Política de tratamiento de datos personales de Aiaate Systems;
• la Política de cookies;
• otros documentos publicados en el Sitio web y en la interfaz del Servicio.

12. Usuarios fuera de la Federación Rusa

Los Usuarios ubicados fuera de la Federación Rusa pueden tener derechos adicionales conforme a la legislación del país en el que se encuentren.

13. Ley aplicable y resolución de disputas

El presente Acuerdo se rige por la legislación de la Federación Rusa.

Todas las discrepancias se resolverán mediante negociación.

Si no es posible llegar a un acuerdo, la disputa se resolverá conforme a la legislación de la Federación Rusa.

14. Idioma prioritario

En caso de traducción del presente Acuerdo a otros idiomas, la versión en ruso tendrá fuerza legal.
